Introduction
UniGlobe Partners LLP (“UniGlobe,” “we,” “our,” or “us”) complies with the Foreign Account Tax Compliance Act (“FATCA”), a United States federal law designed to prevent tax evasion by U.S. persons holding accounts or investments in foreign financial institutions. As a platform operating under international financial standards, we are required to identify and report certain information regarding “U.S. Persons” to the relevant tax authorities.
By using the Platform, you agree to provide the necessary documentation to establish your tax residency status.
Definition of a U.S. Person
For the purposes of FATCA, a “U.S. Person” includes, but is not limited to:
- A citizen of the United States (including those with dual citizenship).
- A lawful resident of the United States (holding a “Green Card”).
- A person meeting the “Substantial Presence Test” (staying in the U.S. for a specific period during the calendar year).
- An entity (corporation or partnership) organized or created in the United States or under U.S. law.
- Certain trusts or estates subject to U.S. tax jurisdiction.
Information Collection & Reporting
- Tax Documentation – Users may be required to submit IRS forms, such as Form W-9 (for U.S. Persons) or Form W-8BEN/W-8BEN-E (for non-U.S. Persons).
- Self-Certification – During account registration or verification, you must certify whether or not you are a U.S. Person.
- Reporting to Authorities – If a User is identified as a U.S. Person, UniGlobe may be required to report account balances, pledges, and personal identification (TIN/SSN) to the Inland Revenue Authority of Singapore (IRAS) for exchange with the U.S. Internal Revenue Service (IRS).
- Withholding Tax – In certain cases of non-compliance or failure to provide documentation, we may be legally obligated to apply a backup withholding tax on payments or withdrawals.
User Responsibilities
- You must provide accurate and complete tax information.
- You are responsible for notifying UniGlobe within 30 days of any change in your circumstances that affects your tax residency status (e.g., moving to the U.S. or obtaining a Green Card).
- UniGlobe Partners LLP does not provide tax advice. Users are encouraged to consult with a qualified tax professional regarding their FATCA obligations.
Account Suspension for Non-Compliance
Failure to provide required FATCA documentation or providing false information may result in:
- Restrictions on launching new Campaigns.
- Temporary suspension of the ability to make or receive Pledges.
- Termination of the User account.
Privacy & Data Protection
Any personal data collected for FATCA purposes will be handled in accordance with our Privacy Policy and applicable data protection laws. Information will only be disclosed to tax authorities as required by legal mandate.
